Legal
Terms and conditions
These terms are being drafted by the operator's solicitor. Several of the items below are also unanswered in the venue's own published information, so they need settling once and stating consistently in both places.
Status
Awaiting text from the operator’s solicitor. This site does not publish legal wording that has not been reviewed by someone qualified to write it.
The rules it has to meet
Governing law
- Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010 (Cth)
- Consumer guarantees, which cannot be excluded or limited by a term in this document
- Liquor Act 1992 (Qld), for the bar and beverage service on the property
- Queensland tenancy and short-stay rules as they apply to the guest cottages
The brief
What the finished document must cover
Compiled from what this site actually does, so the drafting starts from the real system rather than from a template.
- 01What a booking is: when a date is held, when it is confirmed, and what turns an enquiry into a contract.
- 02Deposit amount, the payment schedule, and what is refundable at each stage.
- 03Cancellation and postponement, including what happens to a deposit when a date moves rather than ends.
- 04Wet-weather switching: who calls it, when the call is made, and whether moving indoors changes the price.
- 05Minimum spend and minimum guest numbers, if either applies, and how they are calculated.
- 06External suppliers: whether a preferred list is mandatory, and what insurance a supplier has to carry.
- 07Exclusive use, stated as a mechanic rather than as an adjective, including what else can be on the property that day.
- 08Cottage stays: check-in and check-out, damage, guest numbers, and whether children and pets are permitted.
- 09Liability, insurance and indemnity, drafted so it does not attempt to exclude a consumer guarantee.
- 10Force majeure, written against the last five years rather than against a template from before them.
